Valencia’s Mother Seeks Compensation from Deputy Commissioner

A pre trial review session was scheduled to take place inside the courtroom of Justice Shona Griffith in a civil suit brought against Deputy Commissioner of Police, Miguel Segura. As you may recall, in August 2014, Segura was in an road traffic accident on the George Price Highway which resulted in the death of 55 year old Yolanda Valencia and left taxi driver Yani Cu seriously injured. Yolanda ValenciaSegura was criminally charged for a slew of offences including manslaughter by negligence, causing death by careless conduct and driving with alcohol concentration above the prescribed limit. Valencia’s mother, Guadalupe Valencia who is represented by Attorney Kareem Musa, believes that she deserves financial compensation from Segura. Reporter Hipolito Novelo, spoke to Musa outside the courtroom, of Justice Griffith.

HIPOLITO NOVELO REPORTING

“Yolanda Valencia was killed in a traffic accident on August 16, 2014. She was the passenger in a taxi being driven at the time by Yani Cu who received serious body injuries. Deputy Commissioner of Police, Miguel Segura crashed into the taxi while on his way to Benque from San Ignacio. Valencia died on impact while Cu was rushed to the hospital. Segura was criminal charged for a slew of offences including drunk driving, causing death by careless conduct and manslaughter by negligence.  It is that negligence the thrush of Guadalupe Valencia’s suit against Segura as explained by her attorney, Kareem Musa.”

“This morning was the pretrial review for  the case of Guadalupe  Valencia who is my client and three other children of Ms. Yolanda Valencia, they are also claimants in this action against Deputy Commissioner of Police, I don’t know if he still holds that rank, Miguel Segura, the Government of Belize by extension because as you know on that morning Mr. Segura was driving a government issued motor vehicle and thus the government in the event  we are to succeed in our claim would likewise be liable for anything Mr. Segura would have done in their vehicle. Our contention, I don’t want to go too much into the case, the merits of the case, but our contention is that on that morning, Mr. Segura was under the influence of alcohol which caused him to veer on to the left-hand side of the highway which was the right hand side of Mr. Yannick Ku, he was the driver with Ms Yolanda Valencia who was a passenger that morning. He drove into their path and there was a collision which resulted in the death of Ms. Yolanda Valencia. So the claim today that I had brought today is on behalf of Guadalupe Valencia who is the mother of Yolanda Valencia and it is a claim for damages, for the negligence that cause the accident that morning.”

“Valencia, as the claimant, was a dependent of Yolanda Valencia and her claim is rooted in the Torts Acts of the Laws of Belize.”

“Ms. Valencia was a dependent on her daughter, meaning that she, Ms Yolanda was the bread winner for the family; she use to take care of all the household and medical expenses for Guadalupe Valencia so there is a financial loss that has occurred as a result of this tragic accident and that is what we’re seeking damages for to ensure that Mrs. Guadalupe Valencia is now able to be compensated for the losses she has suffered since the accident.”

“Today was set for a pre-trial session but Attorney Phillip Palacio made an application to have himself remove from the records and so the parties will meet at the end of the month after which the trail is expected to commenced on February 15.”

“Initially we were waiting for the criminal prosecution to be completed normally that’s the course you normally wait for but in this instance that never took place. I don’t know what’s the status of the criminal investigation. I know as a matter of fact and it is now public record to see that the government has disclosed the entire police prosecution file in the criminal investigation in this action and it is completely damning against Mr. Segura. Damning. I don’t know where the criminal trial stands but certainly we had that one year period we had to file before and we were within that time frame and so that is why now, we can proceed and I believe that the trial will go on on February 15 as planned.
