The appeal by 25 year old Ludin Najera , a taxi driver of San Ignacio was dismissed yesterday by the Belize court of appeal. Najera was convicted of rape and was sentenced to 11 years. The conviction and sentence were affirmed and the reason will be given in writing at a later date.
The appeal was dismissed after the Judges of the court of appeal heard the grounds of appeal from attorney Hubert Elrington and the response from the Director of public prosecution Cheryl Lyn Vidal.
The incident occurred between June 11th and June 12th 2008 in San Ignacio. The complainant a 25 year old American was doing health studies and had chosen San Ignacio Hospital to do her internship.
She testified that she and a friend hired Najera to take them home, after dropping off her friend Najera took her to a dirt road and raped her. Najera was convicted on February 25th 2011 and was sentenced on March 3rd.
