The Government of Belize has been spared a multi-million-dollar payout following a decision by the Court of Appeal, which overturned a High Court ruling and clarified the law surrounding duplicate land titles. The ruling, handed down on Friday, reversed a $2.1 million liability and provided the government with a new legal precedent to fight future compensation claims. The case, Rudolph Ramirez & Anor v. The Attorney General, centered on a long-standing issue where the Government inadvertently or otherwise issues title to the same piece of land to more than one person. Historically, such cases have resulted in the government being forced to pay the market value of the land to one of the titleholders, a sum often far exceeding the original purchase price. The Ramirez case involved 14.76 acres of land on Cats Caye, which the Government sold in 2008 to Rudolph Ramirez, who in turn sold it to Julius Zabaneh. Unbeknownst to them at the time, the same land had been sold by the Government to a different individual three years earlier. When the claimants sued for $8.9 million in compensation, the High Court, feeling bound by a previous decision in the case of Andre Vega, awarded them over $2 million. The claimants appealed this award, deeming it insufficient. However, the Court of Appeal sided with the government’s argument that the claimants knew the government did not own the land when the title was reissued in 2019 and therefore should be barred from receiving any compensation. The court’s decision also clarified its previous ruling in the Vega case, stating that it should not be used as a general precedent, but rather confined to its specific facts where the subsequent purchaser had no knowledge of the prior sale. The Attorney General’s Ministry announced the victory, indicating that the ruling empowers the Government of Belize to “push back and fight these types of claims with vigour.
