Belize City Construction Worker Pleads Guilty to Assault Charges After Viral Video Surfaces

A Belize City construction worker wasted no time in court today when he was read charges of common assault and using threatening words.  33-year-old, Emerson Garnett, appeared in the Belize City Magistrate’s Court, and pleaded guilty.  Today’s arraignment comes after a video went viral on Facebook, showcasing almost three minutes of assault upon one Mark Avilez.  Despite Garnett’s guilty plea, the Senior Magistrate took issue with the charge of common assault, saying that it was too lenient a charge for the offense.  During the hearing, the prosecution withdrew the charge of threatening words since the threat to kill Avilez was not done in a public space.  The magistrate eventually accepted the guilty plea and fined Garnett five hundred and five dollars, to be paid by the end of July.  Garnett was all smiles when he walked out the courthouse, and told Court Reporter, Anita Nembhard, that he was guilty and had no interest in wasting time in court.

Emerson Garnett, Pleads Guilty to Common Assault: “The reason why I plead guilty is because I don’t want to waste the court’s time, I don’t want to waste my time because I have my job and I don’t want to lose my job same way too. But yeah short and sweet thanks.”

Reporter: But you know in my view you watched the video, you saw the video right ? 

Emerson Garnett, Pleads Guilty to Common Assault: “I saw the video.”

Reporter: The video looks like you? That person looks like you ?

Emerson Garnett, Pleads Guilty to Common Assault: “Well the person doesn’t look like me but at the end of the day it’s me so I will take the weight of what comes my way you understand ? Once I do something I don’t mind take the weight of it and take the consequence that comes behind it but besides that once I didn’t do it I would just have plead not guilty but I didn’t want to waste the court’s time because I know I did it so I will just take the weight of what comes my way because it’s me who did it.”

Reporter: You were charged with common assault. The magistrate questioned the charge.

Emerson Garnett, Pleads Guilty to Common Assault: “Yeah.”

Reporter: Do you believe that was common assault ? 

Emerson Garnett, Pleads Guilty to Common Assault: “Yeah because I didn’t use any weapon or anything like that I just slapped the person about three or four times.”

Reporter: How about the bowl ? What do you have to say about the bowl ? 

Emerson Garnett, Pleads Guilty to Common Assault: “I don’t really want to talk about that part there.”

Reporter: At the end of the day, the virtual complainant wants any court action ? 

Emerson Garnett, Pleads Guilty to Common Assault: “Well from the time they made the report and thing and they charged me it looks like it was a court action they want so I don’t want to waste the court’s time, waste my time nor waste anybody’s time so I just plead guilty same way. You understand ?”

For context, the video was taken on the night of March 30 when the victim’s ex-girlfriend called him to take food for her at around eight o’clock.  Avilez told Police that when he took the food, he met Garnett and another man, known to him as Deshawn.  It was at that point that he came under attack.  Avilez was beaten up and injured with a sewerage bowl.  Love News understands that the ex-girlfriend was the one who recorded the assault video.  We further understand that the Police are planning to levy charges against her and the second man in the video aiding in the assault.  Garnett is no stranger to a courtroom as he was only recently acquitted of the 2019 murder of Jose Hilario Diaz.
