Biscayne Man Awaits Sentencing for Assaulting Traffic Officer After Viral Bus Video

Evan Cain was sent to jail today after he pled guilty to assaulting a traffic officer.  While many laughed and found amusement at the video footage taken on Tuesday, Cain did not seem entertained today when he appeared in the Belize City Magistrate’s Court.  Cain was read the charge of aggravated assault this morning by a Magistrate. The 31-year-old resident of Biscayne Village appeared unrepresented when he pled guilty saying that his desire is to resolve the matter quickly so he could return home to care for his mother. The Magistrate asked him if he was remorseful for his actions, and Cain replied that he would apologize to the officer if given the opportunity. With a guilty plea, and a pending apology, the matter was adjourned until December 4 for the sentencing hearing.  On Tuesday, a widely circulated video showed Cain pushing 46-year-old Kenrick Deshield off a Fi We Transport bus after Deshield stopped the bus at a checkpoint on the Philip Goldson Highway. The bus was intercepted due to the obvious standing passengers, which was then compounded by the discovery that the bus was not insured.  The video shows Cain assaulting the traffic officer and ejecting him from the bus near mile one and a half.  While Cain is hoping to resolve the matter quickly, we note that he could face up to five years in prison for assaulting a law enforcement officer in the commission of his duties due to recent amendments to the Criminal Code Act, and the Summary Jurisdiction (Offences) Act. In February, the Senate ratified these amendments, which expanded the definition of aggravated assault to include the protection of prosecutors, judicial officers, public officers, members of the media, teachers, elected officials, and security-related personnel. The amendments also upgraded the use of threatening words or behavior from a summary offense to an indictable offense.
