Clouded by the case brought against Orson Elrington is the landmark decision by the court that now allows men the opportunity to collect social security benefits upon the death of a spouse. What Elrington brought to the court was a constitutional claim that allowed his client, Pastor Dozie to collect close to fifty thousand dollars in benefits following the death of his wife. According to Elrington, it was agreed that a level of equality was missing and as such the government subsequently moved to have the matter corrected.
Cabinet had given its approval to the amendment on Friday, February 29. The regulations amended were 32 and 54 which speaks to the disparities in spousal entitlements to survivor’s benefits and death benefits within the Social Security Scheme.
