Another case that is not as clear-cut as one would think is the robbery that turned fatal in Western Paradise Village. *Nineteen-year-old Ashton Samuels was killed and his accomplice *Tyler Ramclam was shot in the leg by the owner of Jacky’s Fast Food and Supermarket during a foiled robbery on July twenty-two. According to Police Commissioner Chester Williams, the file will be sent to the Director of Public Prosecution who after revision will determine how the case proceeds.
Chester Williams, Commissioner of Police: “The file will be put together and will be sent to the Director of Public Prosecution to make a determination as to how we proceed.”
Reporter: So those cases are not clear cut ? You come you rob me and I defended my property and my life.
Chester Williams, Commissioner of Police: “Well to some extent it is because the criminal code does make provision for that either under section 36 where it deals with the right to protect yourself and protect others or under section 39 the right to protect your property. So it is governed and the law dictates that once that occurs the police must not charge but we are to send the file to the DPP and the DPP must determine what the outcome is going to be.”
