Judge Admits Key Evidence in Trial of Lincoln Diaz for Murder of ‘Bredda O’

The murder trial of Lincoln Daniel Diaz, accused of killing Orin Velasquez—better known as “Bredda O”—four years ago, continues in the High Court after a pivotal ruling by Justice Candace Nanton earlier today. Justice Nanton admitted Diaz’s alleged caution statement and police interview as evidence, marking a significant development in the case.  Diaz, now 23, was only 19 when he was accused of gunning down Velasquez inside his business on Perez Road, Ladyville, on November 3, 2020. Velasquez, a well-known figure in the community, was shot and killed in his pizza establishment, a crime that shook the area.  During a voir dire—a trial within a trial to determine the admissibility of evidence—Justice Nanton ruled that the caution statement Diaz allegedly gave to police was made voluntarily and is admissible. The court found that Diaz was properly cautioned and informed that he was not obligated to say anything. Despite this, he reportedly participated in the interview and gave the statement. These findings were critical in linking Diaz to the crime.  The voir dire had begun on Monday, November 18, and concluded on Friday with the judge reserving her decision until today. With the ruling, the trial resumed immediately.  This afternoon, the prosecution presented four agreed witness statements and called one witness to testify. Diaz is represented by attorney Lynden Jones while the prosecution, led by the Office of the DPP, alleges that Diaz acted jointly with others to carry out the murder. However, Diaz is the only person ever arrested and charged in connection with the crime.  The prosecution plans to call five additional witnesses tomorrow, as they aim to solidify their case before closing arguments. Once the Crown rests, the defense will have the opportunity to present its case.  The case continues tomorrow morning at 9 a.m. before Justice Candace Nanton.
