The Paguada brothers, Delson and Tionne have been found guilty of killing Jimell Paul Jex on January 23, 2018. The case wrapped up this morning before Justice Nigel Pilgrim in Belize’s High Court. There was a third accused, 51-year-old, Timothy Carcamo who was charged jointly with the brothers, but due to lack of evidence against him, Justice Pilgrim acquitted Carcamo. Upon his exit from the courthouse, Court Reporter Anita Nembhard spoke briefly with him.
During the trial, the prosecution was able to produce a witness who testified to seeing the Paguada brothers shoot the victim after dragging him off his bicycle near a boat yard on the island. Jex was shot five times, including one shot to the head and two to his chest. While the witness had positively identified the Paguada brothers, she was uncertain of the third accused. The witness cemented her statement by saying that she has known the Paguada brothers for fifteen years. As it relates to Carcamo’s acquittal, Justice Pilgrim notes that the Police should have carried out a proper identification parade and invite the witness to pinpoint who she saw as the third person. Justice Pilgrim also noted that the law states that for the police to show a witness a picture of the suspect before an ID parade was a major error. The Crown was represented by Attorney Romy Wade of the DPP’s office.
