Threat of Death Case Withdrawn: Smith Freed as Brother Forgives

A “threat of death” case was withdrawn from court today. 57-year-old, Casey Kirl Fitzgerald Smith, appeared in court today to answer to a single charge of threat of death. Last Thursday, Smith’s brother reported to the Police Department that Smith uttered the following words to him “Ah wa kill yuh, yoh wa dead out ya”. In court, Smith pleaded guilty and told the magistrate that his brother was outside the courtroom, prepared to withdraw the matter. His brother, 62-year-old, Robert Dolphin Ferguson, took the stand and told the court that he wishes to withdraw the matter and no longer proceed with the case. The prosecutor asked Ferguson a series of questions to ensure that he was withdrawing the case of his own free will, which he agreed. The sitting magistrate dismissed the charge and Smith was free to go.
