The murder trial for 27-year-old, Dane Khalil Gillett, continues in the High Court before Justice Derick Sylvester. Gillett is accused of the murder of 15-year-old, St. John’s College (SJC) student, Dwayne Darwin Gabourel. The trial is nearing a pivotal stage as the defense prepares a no-case submission. The prosecution alleges that the shooting stemmed from gang-related tensions following the murder of Michael Henry. Gabourel, not involved in any gang activities, was allegedly targeted simply for wearing a red shirt. The prosecution, led by Director of Public Prosecutions Cheryl-Lynn Vidal, concluded their case after calling 30 witnesses. Of these, most provided agreed-upon statements, while two testified in person and were cross-examined by the defense. A critical piece of evidence presented was surveillance footage capturing the shooting. The two-minute video showed a motorcycle entering the area, a gunman firing at Gabourel, and then fleeing on the same motorcycle. The shooter’s face was fully covered, leaving no clear identification from the footage. Meanwhile, circumstantial evidence presented by the prosecution includes a testimony from a police officer who identified Gillett as the shooter based on physical features, including a tattoo on his left arm, light skin tone, and slim built. Gillett’s defense attorney, Orson “OJ” Elrington, has indicated that he will file a no-case submission, arguing that the evidence is insufficient to connect Gillett to the crime. Justice Sylvester has set next Thursday for the no-case arguments, and the 23rd for the prosecution to respond with January 6 set for the defense to reply. The court matter will resume on January 27, 2025, when arguments will be heard, and a decision on the no-case submission will be delivered. The backdrop of the case dates back to September 27, 2021, when Gabourel was sent to a nearby shop by his mother. While purchasing items, he was ambushed and shot multiple times by an assailant who fled the scene on a motorcycle. Gabourel succumbed to his injuries three days later, on September 30, 2021.
