The Magistrate’s Court today imposed a suspended sentence on 20-year-old David Lamb, who pleaded guilty to stealing nine coconuts from the yard of Marcia Cain.  Chief Magistrate Sharon Fraser sentenced Lamb to six months’ imprisonment, suspended for one year, on the condition that he remains on good behaviour and does not breach a peace bond valued at five hundred dollars. (The court explained that no money is payable unless the order is breached.  Under the terms of the order, Lamb is bound over to keep the peace for one year in the sum of $500, must remain at least one hundred feet away from Cain’s property, and must not be convicted of any offence during the probationary period. The court warned that any breach of the peace bond, including even minor infractions such as traffic or bicycle offences, could result in Lamb being ordered to pay the $500 and serve three months in prison.  The sentence followed an emotional hearing, during which Marcia Cain, the virtual complainant, told the court that while the value of the coconuts was small, the issue was part of a long-standing pattern of trespass, loitering, theft, and property damage involving groups of young men in her neighborhood.  Cain testified that she has lived on the property for 48 years but now feels unsafe in her own home. She described several incidents, including trees being cut and falling onto her staircase, and another that narrowly missed her house. Cain also recalled confronting youths while ill in bed and said repeated attempts at mediation through the Queen Street Police Station, including meetings with parents, failed to stop the behaviour.  Addressing Lamb directly, Cain said her decision to pursue court action was not driven by revenge, but by a desire to set boundaries and restore peace. Cain’s 28-year-old daughter also addressed the court, corroborating her mother’s account and detailing additional encounters and property damage.  In handing down the sentence, Chief Magistrate Fraser said she requested Cain’s presence to better understand the impact of the offence. She noted that Lamb appeared to minimize the matter by referring to it as “just coconuts,” but emphasized that repeated trespass and theft undermine personal security and peace of mind.

The Chief Magistrate explained that the suspended sentence reflects a restorative justice approach, stating that imprisonment or a fine alone would not address the root of the problem. The court further indicated that steps will be taken to identify other youths involved, some of whom are reportedly minors aged 11 and 15, with the intention of involving a juvenile social worker to conduct wellness checks and engage both the youths and their parents.
