A major legal challenge is underway as Former Leader of the Opposition Moses “Shyne” Barrow has filed for judicial review against the Election and Boundaries Commission (EBC) and the Attorney General. In a legal application submitted to the Supreme Court, Barrow and other UDP executives argue that the EBC acted unlawfully when it authorized 15 candidates aligned with Tracy to use the traditional UDP red color and identify as UDP candidates for the 2025 General Elections. Barrow argue that these individuals are not official members of the UDP and were not endorsed by the party’s executive, making the EBC’s decision a violation of their constitutional rights and electoral laws. The application calls the decision irrational, unreasonable, and made in bad faith, undermining the party’s freedom of association and the principle of free and fair elections. Barrow is now seeking an injunction to block the use of the party’s name, colors, and symbols by the Panton-affiliated candidates. They are also requesting a court declaration that the EBC’s February 25th decision is null and void, and seeking damages for breach of constitutional rights. It yet to be seen what will be the ramifications, if any, once the court sides with Barrow. Our newsroom understands that the Attorney General’s office is seeking an extension of two weeks to respond to Barrow’s submission.
